On August 20, 2018, Chris Miller scored yet another jury trial victory in a medical malpractice case. Chris and his team represented an emergency physician in a claim for alleged failure to diagnose a femur fracture. The physician ordered x-rays of the injured right leg, but through an error by the hospital, the left leg was x-rayed. The radiology report provided to our client did mention findings in the left leg, as well as stating there was no fracture. The patient was diagnosed with a femur fracture approximately 5 ½ weeks later. The patient sued claiming significant injuries from the delay in diagnosis, including a permanent failure of the fracture to heal. After a one week trial, the jury returned a verdict finding Chris’s client was not negligent.
